User Agreement
This User Service Agreement (hereinafter referred to as the "Agreement") is an agreement concluded between you (hereinafter referred to as the "User") and the game operator and its affiliated companies and strategic partners regarding the products and services (hereinafter collectively referred to as the "Products and Services") provided on its game platform.
You should read this Agreement carefully before clicking to agree to it during the registration process. Please be sure to read carefully and fully understand the contents of each clause, especially the clauses that exempt or limit liability ("Disclaimer Clauses"), the clauses that restrict user rights ("Restriction Clauses"), the clauses that stipulate dispute resolution methods and jurisdiction, and the separate agreement for activating or using a certain service. The foregoing disclaimers, limitations, dispute resolution methods and jurisdictional clauses shall apply to the maximum extent permitted by the applicable governing laws and will be marked in bold and underlined. You should read them carefully because these clauses may clarify the obligations you should perform or limit your rights. In addition, pursuant to Article 14 of this Agreement, the game operator has the right to modify and update this Agreement from time to time. Users are advised to pay attention to the latest version of this Agreement.
The conclusion, performance, interpretation and dispute resolution of this Agreement shall be subject to the laws of the People's Republic of China (Mainland China) and all other conflict of laws shall be excluded. If any dispute or controversy arises between you and the game operator due to this Agreement (including but not limited to contractual or other property rights disputes), the parties shall make every effort to resolve it through friendly negotiation; if the negotiation fails, either party has the right to request the Zhuhai Court of International Arbitration (ZCIA) to resolve the dispute between the two parties in accordance with the arbitration rules in force at the time of application for arbitration. If simplified proceedings are applicable under the effective arbitration rules, the parties agree to apply the simplified proceedings. The arbitration tribunal shall consist of one arbitrator and the arbitration hearing shall be held in Guangzhou. The losing party shall bear the arbitration costs and attorney fees. The arbitration award is final and binding on both parties.
The Important Notices are an integral part of this Agreement and, together with the other contents of this Agreement, constitute the complete agreement between you and the game operator.
1. Service Content
1. The specific content of game products and services refers to the various online operation services related to the game provided to you, including but not limited to the official game website, game forum, points mall, gift package center, etc.
2. Game operators may charge certain fees to some users when providing products and services. In this case, there will be clear instructions on the relevant pages. If the user does not agree to pay such fees, he or she may choose not to accept the corresponding products and services.
3. Game operators access the Internet through server-side equipment to provide products and services to users. In addition, the equipment related to products and services (such as computers, modems and other devices related to Internet access) and the required fees (such as telephone charges and Internet access fees paid for Internet access) shall be borne by the users. Users should use genuine software to receive products and services, and the software costs are borne by the users themselves.
2. Game Account
1. After the user reads and agrees to this Agreement and successfully completes the registration, he/she will become a registered user of the game and obtain a game user account (hereinafter referred to as the "game account"). The game account name cannot be changed after registration, but the password corresponding to the account can be modified through the customer service provided by the game operator.
2. The user is fully responsible for the safekeeping of the game account and password and all actions performed using the account and password. It is prohibited to sell, transfer, lend or share game accounts or passwords with others. The game operator shall not be liable for any illegal use of the user's game account or password by others due to the user's negligence in custody or any third-party behavior, nor for any consequences arising therefrom.
3. If a user finds that his game account or password has been illegally used by others or is used abnormally, he should promptly notify the game operator in accordance with the handling method announced from time to time by the game operator, and has the right to request the game operator to take measures to suspend the login and use of the account. The game operator will decide whether to suspend the login and use of the user account based on the results of the user identity verification. You will be solely responsible for any losses caused to you and other users due to taking corresponding measures based on your request. If you do not provide valid identity information or the valid personal identity information you provide is inconsistent with the registered identity information, we have the right to reject your request, and you will bear any losses caused to you.
4. Provide registration information
(1) When applying for a game account (or supplementing information after registration), users should provide the game operator with the latest, detailed, true and accurate personal registration information. The aforementioned personal registration information includes: the user's game account name, password and all information entered when registering a game account (or when supplementing or updating account information). The user hereby promises that the user will register as a game user with his or her real identity and ensure that the personal identity information provided is true, complete and valid, and will bear the corresponding legal responsibility for the information provided in accordance with legal provisions and essential terms and conditions. The game operator should provide users with necessary assistance and support such as account registrant proof and original registration information, and provide relevant evidence and information to relevant administrative and judicial authorities as needed.
(2) All personal registration information provided by users may be used by game operators as a basis for determining the association of game accounts and identifying users. The user agrees to provide supporting documentation of such information at any time upon request by the game operator so that the game operator can verify the user's identity.
(3) If the information provided by the user to the game operator is inaccurate, untrue, illegal or invalid, has been changed but not updated in a timely manner, or is misleading in any way, the game operator has the right to suspend or terminate the user's use of any of the game operator's services until the user provides information that meets the requirements. When a game operator takes suspension measures, it should notify the user and inform the suspension period. The suspension period should be reasonable. Upon expiration of the suspension period, the game operator should promptly resume services to the user.
(4) The game operator has the right to review whether the identity information provided by the user during registration is true and valid, and should actively take reasonable measures such as technology and management to ensure the security and validity of the user account; the user has the obligation to properly keep his account and password, and use his account and password correctly and safely. If any party fails to fulfill the above obligations and causes loss of account passwords, account theft, etc., which causes damage to the rights of the other party or others, it shall bear the legal liability arising therefrom.
5. The user agrees that all information, data and records related to his game account (including but not limited to login records, post-login behavior records, point card information, etc.) shall be based on the data recorded by the game system.
6. If the user does not agree to the terms of this Agreement, or has objections to the terms subsequently modified or updated by the game operator, or is dissatisfied with the products and services provided by the game operator, the user may choose to stop using the game operator's products and services at any time. If the user chooses to stop using the game operator's products and services, the game operator will no longer bear any obligations or responsibilities to the user.
3. User Information Collection, Use and Protection
1. The registration information described in Article 2 of this Agreement, as well as the non-public information stored within the control of the Game Operator when the User uses products and services (hereinafter collectively referred to as "User Information"), shall be disclosed and protected in accordance with the provisions of this Article.
2. In order to provide users with better products and services, if users voluntarily choose to use the products and services of the game operator, or explicitly agree to provide information, the game operator may collect user information and may analyze and integrate such information. When users use the products and services of the game operator, the server may automatically record some user information, which will become part of the game operator's trade secrets.
3. Protecting the privacy of users (especially underage users) is a basic principle of game operators. Game operators have always actively taken reasonable technical and management measures to ensure the security and confidentiality of user information.
4. Except for the four circumstances listed in Article 3, Paragraph 4 of this Agreement, the Game Operator guarantees not to disclose or provide user information to the public or to any third party. The four exceptions are as follows:
(1) The user (or the user's guardian) requests or agrees that the game operator discloses user information;
(2) Relevant laws and regulations require game operators to disclose user information;
(3) Judicial or administrative authorities require the game operator to disclose user information based on legal procedures;
(4) Disclosure of user information is required when filing a lawsuit or arbitration against a user in order to protect the legitimate rights and interests (intellectual property rights and other rights) of the game operator;
5. In order to provide products and services to users normally, the game operator may need to transmit some user information to the game operator's technical service providers, affiliated companies or other third parties. On the premise that these third parties promise that they will assume confidentiality obligations at least equal to those of the game operator, the game operator will transmit user information to these third parties, and users understand and agree to this.
6. Without disclosing the privacy information of individual users, the game operator has the right to conduct technical analysis of the entire user information database and make commercial use of the analyzed and organized user database.
7. The game operator will take commercially reasonable and feasible measures to protect the security of users' personal information. The Game Operator uses commonly available security technologies and procedures to protect users' personal information from unauthorized access, use or disclosure.
4. User Code of Conduct
1. Users agree to regulate their own behavior in accordance with various rules, including this Agreement, issued or changed from time to time by the game operator, and thus accept and use the products and services of the game operator. Users have the rights and bear the responsibilities for the actions generated by their accounts after logging in in accordance with the law. The User further agrees that, in the event of violation of these rules, he shall bear the consequences of the violation and the liability for breach of contract in accordance with the provisions of Article 4, Paragraph 14, Paragraph 15, Article 12 and other relevant provisions of this Agreement.
2. During the use of the game account, the user must abide by the laws and regulations of the user's location related to the release of Internet information and the generally applicable Internet general ethics and etiquette standards. The user will bear the responsibility for the content of the information released by the user. All kinds of information published by users shall not contain the following contents:
(1) Violating the basic principles established by the Constitution;
(2) endangering national security, leaking state secrets, subverting state power, or undermining national unity;
(3) Damaging the national honor and interests;
(4) Inciting ethnic hatred or discrimination, or undermining ethnic unity;
(5) Undermining the state's religious policies and promoting evil cults and feudal superstitions;
(6) Spreading rumors, disrupting social order, and undermining social stability;
(7) Spreading obscene, pornographic, gambling, violent, murderous, terrorist information or instigating crimes;
(8) Insulting, slandering or maliciously attacking others with words, infringing upon the legitimate rights and interests of others;
(9) Infringement of any third party’s intellectual property rights, copyright or publicity/privacy rights;
(10) Violating human ethics, customs and habits;
(11) Disrupting the normal order of the game;
(12) Containing other content prohibited by laws or administrative regulations.
3. The names of users' game accounts and the names of characters, gangs, etc. in the game should comply with the principles of legality and health. Names including but not limited to those involving race, religion, politics, national leaders, obscenity, vulgarity, defamation, intimidation, fraud, aggression, insult, potential for misunderstanding, banned drugs, etc. are not allowed.
4. Users should be responsible for their words and actions in the game, and in particular should not:
(1) Spread or disseminate vulgar or indecent information by any means or behavior;
(2) Impersonating the platform or game system to spread or disseminate false information to other users through any means or behaviors;
(3) Causing disputes by any means or channels;
(4) Distribute or spread, use private servers, Trojans, plug-ins, viruses and such information by any means or actions;
(5) Spread or disseminate information about power leveling through any means or behaviors;
(6) Spreading or conducting offline transactions of game accounts, virtual currencies, or virtual items through any means or behaviors other than the transaction channels provided by the game operator;
(7) Spreading a large amount of identical or similar phrases or meaningless text, or any information unrelated to the game platform and its games;
(8) Promote or encourage any violent behavior outside the virtual world of the game;
(9) Disclose any game world and real world information of other users, non-users or game platform employees;
(10) Propaganda or release of illegal information, information that violates social ethics, or information that is not conducive to the construction of spiritual civilization, including but not limited to pornography, gambling, cults, terrorism, etc.;
(11) Disseminate any type of advertising information and advertising links through any means or actions;
(12) Posting comments or information that defame or attack the game or its operators;
(13) Other remarks or actions that are not in compliance with laws and regulations, social ethics or the rules of the game.
5. Users shall not interfere with or hinder the normal provision of products and services by game operators, and in particular shall not:
(1) Attacking, invading or overloading the website server of the game operator;
(2) Crack or modify the client program provided by the game operator;
(3) Attacking or invading the game server or game server program of the game operator or overloading the game server;
(4) Unreasonably interfere with or hinder others from using the products and services provided by the game operator;
(5) Exploiting program loopholes and errors (bugs) to disrupt the normal progress of the game or spread such loopholes or errors (bugs);
(6) Directly or indirectly exploiting game bugs (including loopholes or unreasonable phenomena in the game system, program, settings, etc.) or program loopholes to profit or disrupt the game order, or exploiting bugs or loopholes to achieve personal goals;
(7) Produce, use, publish, or disseminate any form of auxiliary tools or programs that hinder the fairness of the game (referring to any files or programs used to gain an advantage in the game but not part of the game platform or the game software), including cheating plug-ins and related auxiliary plug-ins (including but not limited to automatic killing of monsters, automatic leveling, automatic taking of medicine, automatic completion of tasks, acceleration, or operations beyond the scope of game settings);
(8) You may not modify the client program in a way that changes, adds, or reduces the pre-set functions of the game platform, or in any way that causes abnormalities in the data sent by the client to the server.
6. Users shall not disrupt the order of the game, and in particular shall not:
(1) Staying in special places or sensitive areas (including but not limited to event registrants, "immigrant messengers", teleporters, teleportation points, etc.) for a long time, interfering with other users' games;
(2) Conduct malicious PK, clearing the venue, blackmail, extortion, etc.;
(3) Threatening to conduct or inciting other users or non-users to participate in abnormal game content (including but not limited to parades, gatherings to cause disturbances, etc.);
(4) Using characters with similar nicknames to impersonate other people’s friends, NPCs, or official characters to commit fraud inside or outside the game.
7. Users can communicate with the game administrator (hereinafter referred to as "GM"), but they must not do the following when communicating with the GM:
(1) Impersonating the system or GM;
(2) Deceiving or attempting to deceive the GM, including but not limited to misleading the GM, refusing to provide information, providing false information, and any other behavior that attempts to "defraud" the GM;
(3) Violating or ignoring the instructions given by the GM. exist
